Local Anti-Foreclosure Group Presses Case Against State's Largest Foreclosure Company

What: Press Conference & Protest at Bellevue Foreclosure Auction

Time: 10:00 AM
Date: Fri., July 19
Where: Northwest Trustee Services, 13555 SE 36th St., Bellevue, WA 98006
Who: SAFE (Standing Against Foreclosure & Eviction)
Why:

On July 11, Snohomish County Superior Court Judge Richard Okrent denied a motion to dismiss a case against both Quality Loan Service Corp. (QLSC), a Washington State trustee (foreclosing company), and McCarthy & Holthus (M&H), a California law firm representing the banks. The case alleges that QLSC did not act as a neutral party in a foreclosure as required by law, because the lawyers that own and operate M&H also own and operate QLSC.
Based on the above, SAFE (Standing Against Foreclosure & Eviction) is focusing its attention on the inherent bias of Northwest Trustee Services (NTS), the largest foreclosure company in Washington State, and Routh Crabtree Olsen (RCO), the law firm representing the banks. SAFE will be holding a press conference at NTS’s auction on Friday.
According to SAFE member Stephen Price, “NTS and RCO are involved in an unethical conflict of interest. NTS is required to act as a neutral party during the foreclosure process, but they are represented by RCO and owned by RCO lawyers. How can a homeowner expect fair treatment when the trustee is owned by lawyers representing the banks?”
“This conflict of interest,” says Scott Stafne, the lawyer who filed the case against QLSC and M&H, “throws into jeopardy all the home sales done by Northwest Trustee Services. Anyone buying a home at an NTS auction could become embroiled in a legal quagmire.”
